Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Kacrow at kacrow.com and related pages (the “Site”). By browsing, searching, creating an account, copying a coupon code, or clicking any listing, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

We may update these Terms at any time. The “Last updated” date above will change when we do. Material changes may also be noted on the Site. Continued use after changes means you accept the revised Terms.

2. What Kacrow is — and is not

Kacrow provides information, search, and listings for Nepal travel deals, discount codes, guides, news, and partner businesses aimed at international visitors. Unless a specific listing clearly states that you book or pay through Kacrow, we are not the merchant, tour operator, hotel, restaurant, agent, insurer, or payment processor for that offer.

• We do not guarantee that any listing is current, complete, accurate, lawful, or available.
• We do not guarantee that a partner will accept a coupon, honor a discount, hold a price, provide a service, or treat you in any particular way.
• We do not control partner staffing, safety practices, licenses, taxes, refunds, cancellations, or customer service.
• Display of a business or deal is advertising and discovery, not an endorsement, recommendation, or warranty of quality, legality, or fitness for your needs.

Nothing on the Site creates a partnership, joint venture, employment, or agency relationship between you and Kacrow with respect to any partner's services.

3. Third-party offers, coupons & fulfillment

Deals, percentages off, coupon codes, prices in NPR, photos, descriptions, maps, hours, and redemption rules are supplied by independent third parties (“Partners”) or derived from information they provide. Kacrow is not responsible if a Partner:

• Refuses to honor a code, discount, or advertised price;
• Changes or withdraws an offer without updating us;
• Applies different terms, blackout dates, minimum spend, or ID requirements;
• Provides poor, unsafe, delayed, or incomplete service;
• Closes, relocates, or ceases operations;
• Makes a billing, pricing, or tax error;
• Violates local law or consumer rules.

Your remedy for any problem with a product, meal, tour, stay, or experience lies only with the Partner (and applicable law), not with Kacrow. We are not obliged to mediate, reimburse, credit, or resolve disputes between you and a Partner, though we may (without obligation) remove or edit listings reported as misleading.

You must verify offer details, expiry, and eligibility directly with the Partner before you travel, purchase, or rely on a code. Screenshots from the Site do not bind a Partner unless their own policy says so.

4. Prices, currency & taxes

• Listed prices are informational. Final amounts may differ after taxes, service charges, tips, exchange rates, seasonal pricing, or Partner policy.
• Our currency convertor and any foreign-exchange display are estimates for convenience only; we do not guarantee rates or timing.
• Kacrow is not responsible for customs, visa fees, permits, insurance, or other costs not shown on a listing.

5. Bookings, payments & refunds

Where a listing says “Book on Kacrow” or similar, any booking flow we provide is subject to additional checkout terms shown at that time. In all other cases, payment and booking happen off the Site (in person, by phone, on a Partner website, etc.).

• Kacrow does not hold customer funds for Partners unless we explicitly say so in writing for a specific product.
• Chargebacks, refunds, cancellations, and no-shows are governed by the Partner's policies and law — not by these Terms alone.
• We are not responsible for failed payments, fraud by third parties, or banking errors outside our control.

6. Partner listings & conduct

Partners are solely responsible for their listings, permits, taxes, consumer disclosures, and compliance with Nepal and other applicable laws. By listing on the Site, Partners represent that their offers are truthful and that they will honor them according to their stated rules. Partners agree to indemnify Kacrow (see Section 11) for claims arising from their offers and conduct.

We may remove, edit, or refuse any listing or Partner account at our discretion, with or without notice, especially for suspected fraud, safety risk, intellectual property complaints, or repeated user reports.

7. Reviews, ratings & user content

Reviews, ratings, photos, and comments may come from users, Partners, or third-party sources. They reflect opinions or aggregated data at a point in time. We do not verify every review for accuracy and are not liable for misleading, defamatory, or outdated user content. You may report content you believe violates law or these Terms to contact@kacrow.com.

If you submit content, you grant Kacrow a non-exclusive, worldwide, royalty-free license to use, display, and adapt it to operate and promote the Site. You represent that you have the right to submit it and that it does not violate others' rights.

8. Accounts & acceptable use

• You are responsible for your login credentials and account activity.
• You must not scrape the Site at scale, reverse engineer, probe security, post spam, impersonate others, or use automated means to copy listings without permission.
• You must not misuse coupon codes, exploit obvious pricing errors, or harass Partners or other users.
• We may suspend or terminate accounts that violate these Terms or applicable law.

9. Guides, news, AI tools & travel risk

Guides, news articles, destination pages, and AI-assisted trip planning (including “Imagine” or similar features) are general information only. They are not legal, medical, visa, safety, or professional travel advice. Conditions in Nepal (weather, roads, permits, political events, health) change quickly.

You assume all risks of travel and activities you choose. Verify visas, insurance, altitude sickness, trekking permits, and safety with official government sources, licensed operators, and qualified professionals before you go. Kacrow is not liable for injury, loss, delay, theft, natural disaster, or government action related to your trip.

10. Analytics, traffic stats & partner reporting

We may show Partners approximate metrics (e.g. listing views, clicks, code copies) from analytics tools. These figures are estimates for internal and partner reporting, not audited financial or legal proof of performance. We do not guarantee accuracy of analytics, attribution, or that a click results in a sale or visit.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Kacrow, its operators, affiliates, and contributors from any claims, damages, fines, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site; (b) your dealings with any Partner; (c) your violation of these Terms or law; (d) content you submit; or (e) your travel activities. Partners agree to the same indemnity for claims arising from their listings and services.

12. Disclaimers & limitation of liability

Please read this section carefully. It limits our liability to you.

THE SITE AND ALL CONTENT, LISTINGS, TOOLS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Kacrow AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, exemplary, or punitive damages;
• Lost profits, revenue, data, goodwill, or business opportunity;
• Damages from Partner non-performance, refusal of coupons, pricing disputes, or service quality;
• Damages from reliance on listings, guides, reviews, maps, or AI-generated content;
• Personal injury, property damage, or death connected to travel or Partner activities, except where liability cannot be excluded by mandatory law.

WHERE LIABILITY CANNOT BE FULLY EXCLUDED, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF: (A) NPR 5,000; OR (B) THE AMOUNT YOU PAID DIRECTLY TO Kacrow FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE EVENT (OFTEN ZERO FOR FREE BROWSING).

Some jurisdictions do not allow certain exclusions; in those cases, our liability is limited to the minimum permitted by law.

13. Third-party links & services

The Site may link to Google Maps, social networks, Partner websites, payment pages, or form providers (e.g. partner intake forms). We do not control and are not responsible for third-party sites, apps, APIs, or their privacy practices. Your use of them is at your own risk and subject to their terms.

14. Intellectual property

The Kacrow name, logos, Site design, and original content are owned by Kacrow or licensors. Partner trademarks belong to Partners. You may not copy, frame, or commercially exploit the Site or listings without written permission, except for personal, non-commercial use of coupon codes as intended on a listing.

15. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, pandemics, war, civil unrest, strikes, power or internet outages, government orders, or failures of third-party hosting or data providers.

16. Governing law & disputes

These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles. Subject to mandatory consumer protections in your country of residence, you agree that courts in Nepal have exclusive jurisdiction over disputes with Kacrow, and you consent to their venue.

Before filing a formal claim, you agree to contact us at contact@kacrow.com with a brief description of the issue so we can try to resolve it informally within 30 days.

17. Miscellaneous

• Severability: If any provision is unenforceable, the rest remains in effect.
• No waiver: Failure to enforce a right is not a waiver of that right.
• Assignment: We may assign these Terms; you may not assign them without our consent.
• Entire agreement: These Terms and the Privacy Policy are the entire agreement regarding the Site, superseding prior understandings on the same subject.
• Language: The English version controls if translated.

18. Legal advice

These Terms are designed for a listing platform but are not a substitute for advice from a qualified lawyer in Nepal or your home country. If you operate a business on Kacrow or rely on offers for commercial purposes, obtain independent legal review.
